Our track records

Motor Insurance

+ A case hard-fought all the way to the Federal Court, we successfully defended Malaysian Assurance Alliance Bhd in a suit brought by beneficiary of a life insurance policy after the claim was rejected. The apex court overruled the Court of Appeal’s decision and held that an insurer is not a trustee for the policy holder in relation to the policy moneys. The principle remains good law until today.

+ Acting for the then Am General Insurance Bhd in a dependency claim filed following a fatal motor accident. Successfully argued before the Court of Appeal that a deceased person’s EPF contributions does not form a part of the loss of support in a dependency claim. This decision set the law in personal injury claims by distinguishing the difference between loss of income (for the benefit of a living victim) and loss of support (for the benefit of a deceased’s dependents).

Professional Indemnity

+ Successfully defended a senior consultant Neurosurgeon (insured by Pacific & Orient Insurance Co Bhd) in a medical negligence claim. After full trial, the High Court found the Neurosurgeon made a right clinical judgment and his management of the patient was in accordance with the standard of medical practice. The Court ordered costs of RM100,000 to be paid to our client.

+ Represented a major hospital in Klang Valley (insured by Syarikat Takaful Malaysia Am Berhad) in a medical negligence suit. Successfully argued before the Court of Appeal to strike out the claim against the hospital for defective pleadings.

Firm believers that a win need not come at all costs, our team is also highly skilled in leading parties toward amicable, shared solutions, especially when liability is adverse against our clients, thereby minimising payouts and saving time and costs. Some of our recent settlement include:

+ In a RM1.8 million motor accident claim involving foot crush injury and traumatic amputation of the toes, a consent judgment was recorded for RM500,000 after cross examination of the Plaintiff’s witnesses.
Butterworth Sessions Court Suit No. PB-A53KJ-319-08/2022.

+ A consent judgment was recorded for RM2.5 million after trial for a costly RM5 million motor accident claim involving traumatic amputation of the limb.
Johor Bahru Sessions Court Suit No. JA-B53KJ-11-01/2019

+ In a RM6 million claim arising out of a traumatic amputation of the arm, a consent judgment was amicably recorded for RM2.3 million.
Kuala Kubu Bharu Sessions Court Suit No. BF-A53KJ-90-09/2021

+ A claim in excess of RM 1 million, arising out of an alleged medical negligence against a General and Hepatopancreatobiliary Surgeon. After extensive negotiations, a consent judgment was recorded for RM230,000.
Penang High Court Suit No. PA-22NCVC-83-04/2021

+ The Plaintiff claimed for damages of approximately RM450,000 from an alleged medical negligence against a General Surgeon. After cross examination of the Plaintiff’s witnesses, a consent judgment was recorded for RM28,000 during trial.

Our track records

+ Successfully defended a former water concession holder against a claim of RM63 million suit filed by Air Selangor Sdn. Bhd. (Air Selangor).

+ We also acted for the same water concession holder against the former chief minister and the State Government of Selangor for the tort of misfeasance of public office. Both claims were amicably settled after cross-examination of the main witness for Air Selangor.

+ Successfully acted for a director of a public listed company in challenging the decisions made by the Appeal Committee of Bursa Malaysia for an order of restoration. A restoration order in excess of RM15 million made against the director was held to be ultra vires the power of Bursa Malaysia and was successfully set aside.
Seek Keng Leong v Bursa Malaysia Securities Bhd.

+ Acted as counsel for a company in a concession contract dispute for wrongful termination of the contract by the Selangor state government. The Federal Court decided in the company’s favour and awarded damages of RM10 million to the company. The apex court’s decision on issues of termination and interpretation of a contract remains landmark legal principles and continues to underpin Malaysian contract law.

+ Represented Encorp Utilities Sdn. Bhd., the concession holder in relation to the privatisation of the water treatment facilities in Beaufort, Sabah for the supply of water to Labuan.

Defamation

Protecting your reputation or advancing your constitutional right to free speech, our partners have been at the forefront of defamation litigation in Malaysia for more than two decades, acting for prominent individuals in either suing or defending. In addition to being actively involved in landmark defamation suits, we assist clients in navigating potential suits.

We successfully defended the then senior opposition leader, Rafizi Ramli in a defamation suit pertaining to statements he published concerning the National Feedlot Corporation scandal. The Federal Court reiterated and clarified the principles underpinning the defence of fair comment, and ultimately the right to free speech and ruled in favour of En Rafizi.

Our track records

+ Acted for one of the main contractors of the LRT 3 Project for unlawful termination of contract by the work package contractor. We resisted the calling of bank guarantees worth RM73 million, negotiated a settlement for the client and secured the bank guarantees.

+ Defended the main contractor of the LRT 3 Project in an adjudication proceeding under the CIPAA and successfully defeated a claim worth RM2 million filed by the subcontractor.

+ Defended the main contractor of the LRT 3 Project in an arbitration proceeding and successfully settled an arbitration worth RM4 million without the client incurring a settlement sum. The Claimant withdrew the claim without liberty to file afresh with no order as to costs.

+ Successfully terminated a winding-up order against the main contractor of the LRT 3 Project.
