Our Track Records

Motor Insurance
- A case hard-fought all the way to the Federal Court, we successfully defended Malaysian Assurance Alliance Bhd in a suit brought by beneficiary of a life insurance policy after the claim was rejected. The apex court overruled the Court of Appeal’s decision and held that an insurer is not a trustee for the policy holder in relation to the policy moneys. The principle remains good law until today.

- Acting for the then Am General Insurance Bhd in a dependency claim filed following a fatal motor accident. Successfully argued before the Court of Appeal that a deceased person’s EPF contributions does not form a part of the loss of support in a dependency claim. This decision set the law in personal injury claims by distinguishing the difference between loss of income (for the benefit of a living victim) and loss of support (for the benefit of a deceased’s dependents).

Professional Indemnity
- Successfully defended a senior consultant Neurosurgeon (insured by Pacific & Orient Insurance Co Bhd) in a medical negligence claim. After full trial, the High Court found the Neurosurgeon made a right clinical judgment and his management of the patient was in accordance with the standard of medical practice. The Court ordered costs of RM100,000 to be paid to our client.

- Represented a major hospital in Klang Valley (insured by Syarikat Takaful Malaysia Am Berhad) in a medical negligence suit. Successfully argued before the Court of Appeal to strike out the claim against the hospital for defective pleadings.

- In a RM1.8 million motor accident claim involving foot crush injury and traumatic amputation of the toes, a consent judgment was recorded for RM500,000 after cross examination of the Plaintiff’s witnesses.
Butterworth Sessions Court Suit No. PB-A53KJ-319-08/2022

- A consent judgment was recorded for RM2.5 million after trial for a costly RM5 million motor accident claim involving traumatic amputation of the limb.
Johor Bahru Sessions Court Suit No. JA-B53KJ-11-01/2019

- In a RM6 million claim arising out of a traumatic amputation of the arm, a consent judgment was amicably recorded for RM2.3 million.
Kuala Kubu Bharu Sessions Court Suit No. BF-A53KJ-90-09/2021

- A claim in excess of RM 1 million, arising out of an alleged medical negligence against a General and Hepatopancreatobiliary Surgeon. After extensive negotiations, a consent judgment was recorded for RM230,000.
Penang High Court Suit No. PA-22NCVC-83-04/2021

- The Plaintiff claimed for damages of approximately RM450,000 from an alleged medical negligence against a General Surgeon. After cross examination of the Plaintiff’s witnesses, a consent judgment was recorded for RM28,000 during trial.
